Litigation
While my focus is to provide diligent counsel to you with the perspective of avoiding litigation, sometimes it is a necessary component of protecting yourself. Indeed, maybe another party filed a lawsuit because they think things will move faster. Maybe you tried operating pro se, or on your own, and you need someone who can inform and work with you to mitigate your damages and set things straight.
Whether the issues arise from a failed real estate transaction, probate administration, guardianship (application or administration), or even in other areas of the law, don’t wait on your rights. New Jersey imposes various levels of time limits that may prevent you from filing a lawsuit; these restrictions are the statutes of limitations. If you file outside the timeframe for your matter, you may be precluded from filing anything at all. Even more pressing, if you have been served with a lawsuit, you only have 35 days to file an answer. In my experience, it is always best to have information as early as possible to avoid needless litigation, but not every case is perfect, and not every detail is available.
